2. Thực trạng khung pháp lý về quản trị dữ liệu y tế tại Việt Nam
Việt Nam đã hoàn thiện bước đầu hệ thống pháp luật về dữ liệu y tế (an ninh mạng, chuyển đổi số, bảo vệ dữ liệu cá nhân, VNeID).
Trọng tâm: Tạo nền tảng chuẩn hóa việc thu thập, lưu trữ, quản lý dữ liệu và nâng cao trách nhiệm giải trình.
Thách thức: Việc chuyển hóa luật thành quy trình vận hành thực tế tại các cơ sở y tế vẫn còn nhiều vướng mắc.
3. Những khoảng trống trong quản trị dữ liệu y tế
So với 8 nguyên tắc Quản trị Dữ liệu y tế toàn cầu, hệ thống còn 5 khoảng trống:
- Thiếu hướng dẫn chi tiết: Quy định khử/ẩn danh dữ liệu chưa cụ thể, gây rủi ro bảo mật thông tin người bệnh trong nghiên cứu.
- Thiếu cơ chế bảo vệ nhóm yếu thế: Chưa có quy định chuyên biệt bảo vệ quyền lợi các nhóm dân cư dễ bị tổn thương.
- Hạn chế về liên thông: Cần tăng cường khả năng tương tác (interoperability) giữa các hệ thống và hợp tác liên ngành.
- Thiếu biện pháp chống phân biệt đối xử: Chưa có cơ chế kiểm soát thiên lệch (bias) và ngăn chặn sử dụng dữ liệu bất lợi cho bệnh nhân.
- Cần nâng cao tính minh bạch: Chưa rõ ràng trong quy trình công bố sự cố dữ liệu và các trường hợp ngoại lệ về đồng ý (informed consent).

World Bank report introduction: Health Data Governance in Viet Nam – From Regulations to Compliance Challenges
As digital transformation continues to advance across the healthcare sector, health data plays an increasingly important role in clinical care, scientific research, health system management, and evidence-based policymaking. However, effectively utilizing health data requires robust governance mechanisms that ensure information security, patient privacy, and compliance with applicable regulations.
To provide a valuable academic resource for faculty members, researchers, postgraduate students, and undergraduate students, the Faculty of Pharmacy is pleased to introduce the report “Health Data Governance in Viet Nam: From Regulations to Compliance Challenges,” published by the World Bank on October 7, 2026.
The report examines the current state of health data governance in Viet Nam, focusing on regulatory frameworks, compliance challenges encountered by healthcare facilities, and recommendations for strengthening health data governance in the context of digital transformation.
1. Overview of the report
- Title: Health Data Governance in Viet Nam: From Regulations to Compliance Challenges.
- Publishing organization: World Bank Group.
- Authors: Sang Minh Le, Hai Van Pham, Giang Ngan Pham, and Ha Hong Le.
- Publication date: October 7, 2026.
- Publication series: Health Discussion Paper.
- Report number: 215614.
- A mixed-methods study evaluating the legal framework, operational compliance challenges, and strategic recommendations for the Ministry of Health.
2. Current regulatory framework for Health data Governance in Viet Nam
Viet Nam has established an initial legal foundation for health data governance, covering cybersecurity, digital transformation, health sector regulations, and personal data protection (including VNeID integration).
Focus: Establishing a standardized framework for data collection, storage, and management, while enhancing institutional accountability.
Challenge: Translating legal provisions into standard operating procedures at healthcare facilities remains a significant hurdle.
3. Regulatory gaps in health data governance
Benchmarked against the 8 Global Health Data Governance Principles, the current framework reveals 5 critical gaps:
- Lack of detailed guidance: Regulations on data de-identification and anonymization lack specificity, posing privacy risks when utilizing patient data for research and management.
- Insufficient safeguards for vulnerable groups: Specific protections for vulnerable population segments in health data collection and sharing remain limited.
- Interoperability constraints: System-wide data sharing requires stronger technical interoperability between digital health platforms and cross-sectoral collaboration.
- Inadequate Anti-Discrimination measures: Mechanisms to control bias and prevent discriminatory uses of health data against patients are incomplete.
- Need for enhanced transparency: Ambiguities remain regarding data breach notification protocols and exceptions to informed consent requirements.
4. Three major compliance challenges for healthcare facilities
- Digital infrastructure: Fragmented and non-standardized IT infrastructure fails to meet the operational demands of modern health data systems.
- Data management capacity: Healthcare personnel lack specialized IT and data protection expertise; data management processes remain unstandardized.
- Financial constraints: Insufficient funding undermines the investment, operation, and long-term sustainability of digital health data infrastructure.
5. Recommendations for strengthening Health Data Governance
- Streamlining the regulatory framework to improve coherence, clarity, and practical implementation.
- Ensuring sustainable financing for health data infrastructure and services.
- Building institutional and professional capacity for health data management.
- Fostering stakeholder engagement, transparency, and accountability in health data governance.
- Developing a clear implementation roadmap to guide the continued improvement of the national health data governance system.
6. Academic and practical relevance to pharmaceutical sciences
The report offers valuable insights for education, scientific research, and health policymaking, particularly in healthcare management, health economics, health informatics, and health data governance.
For the pharmaceutical sector, its findings are relevant to the development of pharmaceutical information systems, drug utilization research, clinical pharmacy, and pharmaceutical management.
